PLACING ORDERS

You may Order from The Establishment Coffee Company if you are aged 18 years or over and have an active email account and a telephone number at which you can be contacted.

If you place consecutive or separate Orders, we cannot consolidate your Orders. A separate Delivery Fee, if applicable, will apply to each Order.

You acknowledge that all Goods purchased under these Terms are intended for personal non-commercial use only and warrant they will not be re-sold. From time to time, The Establishment Coffee Company restricts the quantity of Goods which can be purchased in one Order or during a particular period of time or per person or per address. The Establishment Coffee Company will not be liable to you for loss you or any third party suffers for a delay or failure to process your Order or deliver Goods due to inaccurate or incomplete details provided in an Order you make.

The Establishment Coffee Company reserves the right to accept or reject your Order for any reason at any time. If The Establishment Coffee Company rejects your Order, you will receive a refund of any money paid.

DELIVERIES
Once you have placed your Order, we aim to dispatch the Order within 2 business days. If there are any issues with stock availability, we will contact you as soon as possible. Orders are delivered either by us, an agent appointed by us, or by courier. Delivery times will vary depending on the location of the Delivery Address.
Deliveries are only made in Australia. The delivery fee depends on the weight of the Goods purchased and the Delivery Address. Any Order over $100 will not incur any delivery fee.
An invoice for the Order will be included with the delivery of the Goods.
You must give written notice to us of any invoice corrections, incorrect charges, non-delivery of goods, shortages in quantity of goods, defects of goods or any other order queries within 7 days of delivery of any order to obtain replacements or refunds. If you fail to give such notice within such period you will be deemed to have accepted that the invoiced goods were correctly charged and delivered to you and were of merchantable quality.
All Prices are in Australian Dollars and, if GST applies, are inclusive of GST.

RISK & LIABILITY
Risk and title in the Goods passes to you on the date and time of delivery of the Goods.
The Establishment Coffee Company excludes to the fullest extent possible under law, all implied terms and warranties whether statutory or otherwise, relating to the subject matter of these Terms.
You represent and warrant to The Establishment Coffee Company that The Establishment Coffee Company will not be liable for any expense or injury (including indirect loss such as loss of revenue, profits, anticipated savings, goodwill or business opportunity, injury to your reputation) in contract, tort, under statue or otherwise, howsoever caused including arising directly or indirectly from or in connection with these Terms.
Our liability to you for loss or damage of any kind arising out of these Terms will be reduced or limited to the extent (if any) that you cause or contribute to the loss or damage.
